A 49-year-old father of nine from Malacca was charged with two counts of raping his girlfriend’s 16-year-old daughter at a flat in Jalan Rajawali, Bayan Lepas on April 7. He claimed trial in two Sessions Courts of raping the underage girl last year and this year.
The accused denied the charge of raping the girl who was 15 years and two months old on March 16 last year around 8 pm at the same place. Both offences under Section 376 of the Penal Code carry a punishment of up to 20 years in jail and whipping on conviction.
As reported by The Star, DPPS Lim Saw Sim and Nurul Huda Idris asked the court not to allow bail in consideration of the severity of the offences, they both prosecuted at the respective courts.
However, lawyer R. Sankra said that the rights of the accused should be considered as these were allegations. Judges Irwan Suainbon and Norsalha Hamzah set bail at RM8,000 and RM10,000 in one surety, respectively.
The accused was ordered to surrender his passport to the court and to report to the Bayan Lepas police station every month.
A medical report is pending and the case will be up for mention on June 13.
