KUALA LUMPUR: PAS would be returning to its roots as a East Coast party in the Malay heartland states by opposing the government’s amendments to Law Reforms (Marriages and Divorces) Act 1976, which seeks to ban unilateral conversion of the children by the converting spouse.
“PAS is on the way to making itself once again a marginal party limited to Kelantan and Terengganu,” said UUM adjunct professor and former diplomat M Redzuan Kushairi.
“Its MPs will be limited from nine to 13 seats,” he told Berita Daily.
He said this in response to PAS information chief and Temerloh MP Nasrudin Hasan’s objection towards the proposed amendments.
“It is unfortunate that the government only takes into account the views of only non-Muslims and ignored the demands of the mainstream Muslims.”
“The issue of a child’s faith must be defended by all Muslims. This amendment will rip away the faith of small kids and award victory to the Interfaith Commission of Malaysia’s (IFC) fight that we have together rejected in totality once before.
“But why do we now want to accept this IFC’s struggle that is being brought separately?” Nasruddin questioned.
The amendments to the act will see the inclusion section 88A that clearly states the agreement of both parents are required to enable conversion of a minor to Islam.
The amendment also said that the child will remain in the religion of the parents at the time of marriage until the child is 18 years old, when the child may opt for a faith of their choice.
Meanwhile, Pokok Sena MP Mahfuz Omar of PAS claimed to be in the dark on whether PAS would be opposing the amendment via bloc voting.
“I don’t know about that,” he said.
In the last general election in 2013, PAS won 21 parliament seats. An internal party conflict subsequently reduced the party’s seats to 14 when seven of its MPs formed Amanah.
This is not the first time a PAS lawmaker is seeing red over the amendments.
In the previous parliament sitting, PAS secretary general and Kota Bharu MP, Takiyuddin Hassan threatened that PAS would be against this amendment if no support is given to Hadi Awang’s motion that seeks to increase penalties to the Shariah Courts (Criminal Jurisdiction) Act 1965.
Hadi wants the present the 3 year imprisonment, RM5,000 fine and six strokes of the cane to be raised to 30 years jail term, RM1000,000 fine and 100 strokes of the cane.
Takiyuddin also raised similar concerns that the right of the child to embrace Islam would be at stake.
